These terms and conditions outline the rules and regulations for the use of Kingola & Co Limited trading as Kingola Jewellery's Website, located at https://kingolajewellery.co.uk.

By accessing this website, we assume you accept these terms and conditions. Do not continue to use it if you do not agree to take all of the terms and conditions stated on this page.

  1. GENERAL
    a. ‘Client’ means any person or organisation not acting in the course of a business who has contacted Kingola Jewellery requesting information, or who has entered a Contract with Kingola Jewellery for the provision of Standard and Bespoke Jewellery, repairs to Jewellery, or participation in Workshops.
    b. ‘Bespoke Jewellery’ refers to jewellery individually designed or personalised for a Client.
    c. ‘Standard Jewellery’ refers to jewellery created by Kingola Jewellery as part of a collection, which may be recreated. It includes all jewellery that is not Bespoke.
    d. ‘Contract’ means the legal agreement between Kingola Jewellery and the Client for the supply or repair of jewellery or for the provision of Workshops.
    e. ‘Website’ refers to: https://kingolajewellery.co.uk

    . ‘Price’ is the total payable for the provision of jewellery and repairs as agreed with the Client, including any agreed additional charges.
    g. ‘Delivery Charge’ means the cost of delivering jewellery to the Client.
    h. ‘Charge’ refers to the cost of attending a Workshop.
    j. ‘Payment’ may be made by BACS, card (via card machine or website), PayPal, Apple Pay, or Stripe.
    k. ‘Days’ means all weekdays excluding weekends and UK bank holidays.
    l. These Terms and Conditions and the Contract constitute the entire agreement between Kingola Jewellery and the Client. Any changes must be agreed in writing.

  2. THE JEWELLERY
    a. Kingola Jewellery will describe jewellery as accurately as possible and in good faith.
    b. Clients must ensure that the described items meet their requirements before placing an order. Kingola Jewellery welcomes enquiries and will clarify details when asked.
    c. Essential requirements must be discussed with Kingola Jewellery before placing an order.
    d. Kingola Jewellery warrants to use reasonable care and skill in making or repairing jewellery.
    e. By entering into a Contract, the Client confirms they are over 18 years of age.
    f. Jewellery meeting the legal requirements for weight will be hallmarked by the London Assay Office.
    g. Due to the handmade nature of the products, items may vary slightly from one another.
    h. All materials used are sourced from reputable UK-based suppliers.

  3. DELIVERY
    a. Standard Jewellery is made to order unless marked as "in stock" on the Website. Production typically takes up to 7 days.
    b. Clients requiring delivery by a specific date must notify Kingola Jewellery before placing an order.
    c. Delivery timelines begin once the jewellery is dispatched. Delivery usually occurs within 5–7 days, though it may take up to three weeks.
    d. Delivery times are estimates. Unless agreed in writing, time is not of the essence.
    e. Delays do not entitle Clients to reject orders or demand compensation.
    f. Specific delivery date agreements must be confirmed in writing by Kingola Jewellery.
    g. Price and Delivery Charges do not include customs or other international fees. These are the Client’s responsibility. If unpaid, the jewellery will be returned, and the Client must collect it in person. No refund will be issued.

  4. BESPOKE JEWELLERY
    a. Upon enquiry, Kingola Jewellery will gather details about the desired design, size, style, and budget.
    b. Several design options with pricing and delivery will be presented.
    c. Kingola Jewellery will answer all reasonable questions before the Client selects a design.
    d. Reasonable time will be spent accommodating Client preferences.
    e. Once a design is agreed, the full Price and Delivery Charge become payable via invoice.
    f. Changes after design agreement may incur additional charges.
    g. Work begins after payment is received.
    h. Once work has commenced on a bespoke piece, refunds are not possible.
    i. Finished items will be dispatched via Royal Mail or another suitable courier.

  5. STANDARD JEWELLERY
    a. A Contract is created once payment is made via the Website or direct order.
    b. Confirmation will be sent by email.
    c. Kingola Jewellery strives to ensure accurate Website content but variations may occur.
    d. If an item is unavailable, the Client will be informed and refunded within five days.
    e. Orders may be declined or terminated for material breach of terms.
    f. By placing an order, the Client agrees to these Terms and Conditions.
    g. Website purchases are available for delivery in the UK, EU, USA, and Australia.
    h. Clients outside the UK are responsible for customs and other import fees.
    i. Suspicious activity may result in account suspension. Clients will be informed.
    j. Purchase limits may be imposed per Client.

  6. REPAIRS
    a. Enquiries may involve sending photos or descriptions before an estimate is provided.
    b. Accurate quotations are issued after inspection. If declined, return postage must be paid by the Client.
    c. Repairs are not accepted for certain materials (e.g., opals, Indian silver, copper, non-precious metals).
    d. Items accepted for repair will be assessed and logged.
    e. Repairs are performed at the Client’s risk, especially due to unknown pre-existing conditions.
    f. Client must accurately describe materials and conditions.
    g. Any unexpected issues or added costs will be discussed with the Client.
    h. If additional work arises, Clients will be given the option to proceed.
    i. Final invoices must be paid before return shipping.
    j. Repairs will be shipped by Royal Mail Special Delivery.
    k. For low-value items, upfront payment may be required before repairs begin.

  7. DESIGN ISSUES
    a. Bespoke, personalised, or repaired items cannot be rejected due to stylistic preferences post-delivery.
    b. Kingola Jewellery will work collaboratively on designs before production.
    c. Changes may increase the final Price.
    d. Kingola Jewellery reserves the right to cancel a bespoke order if agreement cannot be reached, refunding any deposit minus costs incurred.

  8. GUARANTEE
    a. Non-business Clients may cancel online orders for Standard Jewellery within 14 days of receipt (excluding earrings and personalised items).
    b. Jewellery must be returned within 14 days in original condition at the Client’s cost.
    c. If returned in suitable condition, the Price (less postage costs) will be refunded. 
    d. One-year workmanship guarantee is provided for Standard and Bespoke items (excluding Client-supplied materials).
    e. Guarantees are void if items are misused or improperly stored.
    f. Legal rights are unaffected.
    g. No guarantee is given for items made from Client-supplied materials.
    h. Poor care voids guarantees.
    i. For Repairs, one re-repair attempt is included if issues arise due to workmanship, unless the issue is deemed inherent to the material.

  9. PRICE AND PAYMENT
    a. Bespoke orders must be paid in full once design is agreed.
    b. Standard Jewellery is paid for upon Website checkout.
    c. Repairs must be paid for before return.
    d. Invoices are payable in full.
    e. Late payments incur 8% interest over base rate, plus recovery costs.

  10. WORKSHOPS
    a. Workshop descriptions are found on the Website.
    b. Booking and payment are via the Website.
    c. Workshops require a minimum of two attendees; rescheduling or refunds apply if not met.
    d. Maximum limits apply for safety and experience quality.
    e. Group workshops involve creating the same piece.
    f. All materials are provided.
    g. Clients must act safely and respectfully.
    h. Photography is only allowed with consent.
    i. Attendees must not share others’ identities on social media.
    j. Clients indemnify Kingola Jewellery from claims arising from workshop attendance.
    k. Alternative workshop attendance may be offered if cancellation occurs.
    l. Rescheduling will be offered for cancellations due to illness or force majeure.
    m. Gift vouchers are valid for one year.
    n. All attendees must be 18+ or provide proof of age.

  11. CANCELLATION POLICY
    a. After the 14-day cancellation period, Standard Jewellery orders cannot be cancelled except by law.
    b. Repair cancellations require payment for completed work and materials.
    c. Bespoke orders cannot be cancelled once work begins.
    d. Kingola Jewellery may cancel orders in the event of unforeseen circumstances.

  12. SUBCONTRACTING
    Kingola Jewellery may subcontract any part of its services.

  13. RISK
    Risk transfers to the Client upon delivery to their premises or nominated address.

  14. INTELLECTUAL PROPERTY
    a. All intellectual property in jewellery, designs, marketing, and content remains the property of Kingola Jewellery.
    b. Any unauthorised use or replication will result in liability and damages.

  15. DATA PROTECTION & CONFIDENTIALITY
    a. Kingola Jewellery handles data per UK GDPR and its Privacy Notice.
    b. Clients' personal information is confidential and not sold to third parties.
    c. Clients may receive marketing updates with the option to unsubscribe.

  16. COMPLAINTS
    Any complaints must be raised immediately and confirmed in writing within seven days.

  17. SEVERANCE
    If any provision is held invalid, the remaining terms remain enforceable.

  18. NOTICES
    Notices must be sent to the addresses provided in the Contract or via agreed emails.

  19. WAIVER
    Failure to enforce a term does not constitute a waiver of future rights.

  20. TRANSFER
    Clients may not transfer rights under the Contract to others.

  21. LIMITATION OF LIABILITY

    a. Kingola & Co Limited trading as Kingola Jewellery (hereinafter referred to as “Kingola Jewellery”) shall not be liable to the Client for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, savings, data, business opportunity, replacement costs, or use, arising out of or in connection with the Goods or the Services provided.

    b. Kingola Jewellery shall not be liable for any damage, loss, or defect arising from misuse, failure to follow care instructions, accidental damage, or reasonable wear and tear.

    c. Kingola Jewellery shall not be liable for any damage, loss, or defect arising from repairs, alterations, or modifications made by the Client or any third party without Kingola Jewellery’s prior written consent.

    d. Kingola Jewellery shall not be liable for any delays or failure to perform any part of the Services due to events beyond its reasonable control, including but not limited to acts of God, governmental actions, pandemics, strikes, extreme weather, or supply chain disruptions.

    e. The total liability of Kingola Jewellery to the Client, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall in no event exceed the amount paid by the Client for the specific Goods or Services giving rise to the claim.

    f. Where Kingola Jewellery advises against a course of action, including the use of certain materials or gemstones, it shall not accept any liability if the Client insists on proceeding against that advice.

    g. All Goods and Services provided by Kingola Jewellery, including access to and use of the website, are offered on an “as is” and “as available” basis. No representations or warranties are made, whether express or implied, including but not limited to those of satisfactory quality, fitness for a particular purpose, non-infringement, accuracy, or availability.

    h. Kingola Jewellery reserves the right to suspend, withdraw or discontinue its Services (including access to its website) at any time, without notice, and without liability.

    i. Website Disclaimer
    To the maximum extent permitted by applicable law, Kingola Jewellery excludes all representations, warranties, and conditions relating to its website and the use of the website. Nothing in this disclaimer shall:

    • limit or exclude Kingola Jewellery’s or the Client’s liability for death or personal injury resulting from negligence;

    • limit or exclude Kingola Jewellery’s or the Client’s liability for fraud or fraudulent misrepresentation;

    • limit any liabilities in any way that is not permitted under applicable law; or

    • exclude any liabilities that may not be excluded under applicable law.

    The limitations and exclusions of liability set out in this Clause 21 and elsewhere in these Terms and Conditions:
    (i) are subject to the preceding paragraph; and
    (ii) govern all liabilities arising under these Terms and Conditions, including liabilities arising in contract, tort, and for breach of statutory duty.

    j. As long as the website and the information and services on the website are provided free of charge, Kingola Jewellery shall not be liable for any loss or damage of any nature arising from their use.

  22. GOVERNING LAW
    These Terms and Conditions are governed by the laws of England and Wales.
